AFFILIATE AGREEMENT: JENSEN BUSINESS ADVISORY, LLC.
(Inclusive of: Jensen Business Advisory, the 728 Network and The Hiring Academy, LLC)

This Affiliate Agreement ("Agreement") is entered into by and between Jensen Business Advisory, LLC. and its subsidiaries or DBAs, collectively referred to as (“Company”), and the undersigned Affiliate ("Affiliate"). This Agreement outlines the terms and conditions of the affiliate roles and responsibilities pertaining to all products and services sold by and for Company and the exchange for such.

1. Affiliate Payment

     A) The Company makes no representations or warranties, verbal or otherwise, regarding potential income compensation via salary, commissions or bonuses that may result from participating in the Affiliate Program. 

     B) The percentage(s) paid as commissions are outlined in section 3 (below) which Company reserves the right to adjust or change at any time and will provide written notice of any such occurrence.

     C) Commissions are calculated once per product, per paid transaction at each individual product's tier/rate, of actual paid revenue (post-discounts applied) including each recurring completed payment for subscription-based services.

     D) Commissions will be based on the final transaction sales price; not including any sales tax, shipping, service fees, late charges, collection costs, and any other payment made to the Company that is not the purchase price of the product.

     E) The Company reserves the right to deduct the costs for any products that are returned or refunded in the subsequent months, attributable to customer cancellation, credit card fraud, bad debt write-off, or for any other reason causing the commission to have been overpaid.

     F) Affiliate commissions, compensation due, will be administered within 30 days.

2. Affiliate Relationship

• Affiliate is an independent contractor and not an employee of the Company or any of its subsidiary entities. No employer-employee relationship is created under this Agreement.

3. Affiliate Commission Structure

• During such time as the below, agreed individual is operating in the role of an Affiliate within the Jensen Business Advisory, LLC. Affiliate Agreement terms, they shall be rewarded compensation for direct referral sales, as defined herein.

        10% Commission Rate: 

• Affiliate will receive a 10% commission on the first initial purchase of products and/or services offered by Jensen Business Advisory, The Hiring Academy, and it subsidiaries. 
• Includes: Private Coaching and/or Consulting programs, VIP Masterminds and Retreats, Live Event tickets, Event Sponsorships, 728 Network, Communities, Online Courses, Group Coaching, Workshops and other Membership Subscription Services.
• PLUS: Earn 5% commission of any additional products or services purchased by the client for the lifetime of the client (as long as they remain under annual renewal service without gap).

4. Ownership of Products and Services

• All products, services, and materials, including but not limited to, intellectual properties, courses, books, online content, webinars, logos, and websites, are owned by Jensen Business Advisory, LLC and are only sold or used with express permission of Company.
• Affiliate is not authorized to copy, sell, distribute, or teach any of the Company’s products or services without prior written consent from the Company.
• The Company reserves all rights under Copyright and Trademark laws at both state and federal levels for all products, services, and related materials.

5. Confidentiality and Non-Disclosure

• Affiliate agrees not to disclose or share any proprietary information, including customer lists, sales data, marketing strategies, intellectual property, product development, and/or other confidential information relating to the Company’s business or its products and services. This shall include any information, personal or otherwise about Company owners, partners or executives.
• This non-disclosure obligation shall remain in effect indefinitely.

6. Termination of Agreement

• Either party may terminate this Agreement at any time, with or without cause, by providing written notice to the other party.
• Upon termination, any commissions due to the Affiliate will be paid at the next scheduled date, according to the payment policy outlined in this Agreement. All future commissions are void upon cancellation of this agreement.

7. Governing Law

• This Agreement shall be governed by and construed in accordance with the laws of Pinellas County in the State of Florida, without regard to any choice of law provisions.
• If any provision of this Agreement, or part thereof, should to any extent be or become invalid or unenforceable, the parties shall agree upon any necessary amendment of the Agreement to achieve the interests and objectives of the parties prevailing at the time of execution of this Agreement.

8. Entire Agreement

• This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, verbal or written, relating to the Affiliate relationship.

By proceeding to CLICK through to the Affiliate Sign-Up Page, with “I AGREE”, accepts all above terms and conditions set forth in this Agreement and I do apply to be an Affiliate for Jensen Business Advisory, LLC.

With my acceptance, as defined in the Affiliate Agreement, I acknowledge that Company may change these compensation terms at any time - with written notice.
